Important: Mark the Federal Extension Circle on Form D-400When you file your North Carolina state tax return, you must certify that a federal extension was granted by filling in the "Federal Extension" circle on page 1 of Form D-400. North Carolina's failure-to-file penalty is the greater of 5% of tax liability per month (up to 25%) or $5. The failure-to-pay penalty is a flat 10% of tax liability—one of the higher flat payment penalties. Filing by October 15 and paying by April 15 avoids both.
